The Contractors State License Board has granted a contractor’s license to a registered citizen who initially applied for a license, but whose license was denied because he is required to register as a sex offender.
The Board’s reversal of its initial decision came after a hearing before an Administrative Law Judge on March 28, 2016. According to the judge, the registered citizen provided substantial, credible evidence of his rehabilitation. The judge noted in his five-page decision that the registrant expressed remorse for his conduct and accepted responsibility for his offense.
“This is a significant victory not only for the registrant who has been granted a license, but also for all registrants seeking a state license,” stated attorney Janice Bellucci.
The registered citizen in this case was convicted of an offense more than 15 years ago and has not re-offended. In addition, he has more than 25 years of experience in his field of expertise. Further, the registrant participated in many volunteer activities, including Habit for Humanity and the Adopt-a-Highway program.
The contractor’s license will take effect in May 2016.

This is justice! This man did and is doing EVERYTHING required of him. He deserves to put his past behind him and move forward with his life.
Terrible that registered status is used to keep someone from earning a living. I’m glad the gentleman pushed back and ultimately won.
Who was the judge in this case? Sounds like a reasonable person actually. I know of one registered citizen that challenged the local board of realtors and kept his license after they threatened to pull it. His case was 30 yrs ago, expunged back in the early 90’s. I retained my state environmental assessor’s license until the program was abandoned and even renewed it after I was a registrant.
The judge did note that the man showed remorse and accepted responsibility for his actions, thus proving he has been rehabilitated. I truly believe most all of the registered citizens have done that too, but to no avail.
There is hope! I have been a registered citizen for 30 years. After my conviction I was the qualifier (RME) for my company’s contractor’s license. In 2000 I applied for my own license. I, too, sent in as much documentation as I could to show rehabilitation. The CSLB never denied my application and I have been a licensed contractor ever since. I would agree that times have changed since then. The “witch hunt” has grown, but my experience and hard work on myself paid off. As I said, there is hope!

If you qualify for expungement and have had your conviction expunged…you might have a decent chance thanks to AB 2396. See link below.

I had my conviction reduced and expunged in Jan of this year. I surrendered my real estate sales license back in 2012 when I was arrested for CP. I might attempt to get my license reinstated at some point.
Perhaps consult an attorney that specializes in state licensing cases. There are lawyers that specialize in this field so it might be a good investment.
If you had one in the past…it might be easier to get it back than if you are trying to get it for the first time.
